These are eventful days for owners of holiday rental properties, with new laws arising at a national and regional level. If you own a rental property, legal advice will be more important than ever. Erardo Ferrer of Lanzarote Abogados describes the new Single Register for Short-Term Rentals, which will come into force this summer.
What is the Single Register for Short-Term Rentals?
The Single Registry for Short-Term Rentals is a procedure carried out at the Property Registry that allocates a unique registration number to each property and allows it to be offered on online short-term rental platforms (Booking, Rentalia, Airbnb, etc.). From July 1, 2025, holiday homes that do not have this number can no longer be advertised.
Who is required to register?
All natural or legal persons who wish to provide short-term rental services for remuneration through an online platform, whether professional or non-professional, on a regular or temporary basis.
Why?
To comply with Regulation (EU) 2024/1028 of the European Parliament and of the European Council of April 11, 2024, Royal Decree 1312/2024 of December 23, regulating the mandatory Single Rental Registry procedure, was published in the Official Spanish State Gazette on December 24, 2024. Spain is the first European country to implement this EU regulation requiring an information system for short term rentals.
What documentation is required to apply for it?
A copy of the tourist license, a copy of the property deed, and the client’s authorization.
Will the future Holiday Rentals Law require registration for classified activities?
No, because this is already required by a decree issued in 2015, which established that vacation homes must comply with the requirements established for classified activities. However, this is an issue that most owners are unaware of, and therefore a requirement that must also be met.
What is required for classified activities?
A technical report must be submitted, describing the activity, its environmental impact, and verification of safety, fire, electrical installation, and occupational risk prevention measures.
