A new law that comes into force next month requires all holiday let owners to register their properties. Erardo Ferrer of Lanzarote Abogados explains:

What happens to your holiday rental property on July 1, 2025?

If you haven’t obtained your new short term rental code from the Property Registry by July 1, 2025, Royal Decree 1312/2024, means that you won’t be able to legally rent out your vacation home. This law, which aims to control and regulate accommodation-sharing platforms such as Airbnb, was passed last December but comes into force next month.

It’s no joke. It doesn’t matter if your licence is valid and in force; without the new code, you will not be able to legally rent out your home for short-term rentals or for tourism purposes.

Who must apply?

All individuals or legal entities wishing to provide short-term accommodation rental services for a fee through an online short term rental platform, whether professional or non-professional, on a regular or temporary basis

What information is required to apply for a rental registration number?

The CRU (Unique Registration Code) in the case of real estate, and the NIB (Vessel Identification Number), the registration number, or the CRU in the case of a boat.

This information can be obtained from the Property Registry or the Movable Property Registry by requesting, for example, a standard nota simple (property registry filing) on the property.

In addition, it is necessary to have all the appropriate authorizations, licenses, visas, or equivalent documents, as well as a declaration that the property has adequate equipment, furniture, and fixtures.

What types of accommodation do we need a registration number for?

These are referred to as “units”, and are defined as furnished accommodations which may or may not encompass the entire property, and are be the subject of a short-term rental service. Therefore, it is possible to offer a room in a property or even on a boat, constituting this “unit.”

Hotels and similar accommodations, including hotel complexes, aparthotels, motels, hostels, campsites, and caravan parks, are excluded from this obligation.
