The driver of the car responsible for the collision that killed a baby and injured six adults was unable to declare in a first hearing at an Arrecife court yesterday due to a nervous breakdown.

23-year-old Olivia Brown has reportedly been in a state of shock since the accident, and yesterday the coroner ruled that she was unfit to give a statement. 

She was released provisionally by the court after prosecutors decided not to request preventive custody and will have to register at the police station twice a month until trial.  Her passport has also been confiscated and she is forbidden to leave Spain.

The parents and maternal grandparents of the infant that was killed remain in hospital, with two in Intensive Care.
